Abstract


The liberalization of the mining sector by the Mining Code of 2002, at the end of mining conventions and the revolution of mining methods, have led an installation of mining companies with foreign capital on the Katangese territory. The objective of the study is therefore to analyze the legal aspect of mining companies and to determine its impact on the socio-economic development of the local population. Tenke Fungurume Mining (TFM), created following the contract between Générale des Carrières et des Mines (GCM) and LUNDIN HOLDINGS LTD. Observation has shown that, on the socio-economic front, TFM has built and rehabilitated health centers and schools; ensure the distribution of drinking water, electricity and agricultural inputs; guarantee a good job to the local people. On the environmental front, the company ensures to have reduced the negative impacts of toxic waste on the environment by treating them before evacuation. However, TFM's activities have also led to underdevelopment of the agricultural sector and a rural exodus resulting in social and cultural imbalance. Results of the study showed that mining has both positive and negative impacts on the socio-economic development of the Katangese population.

La libéralisation du secteur minier par le Code minier de 2002, mettant fin au régime des conventions minières et la révolution des méthodes d’exploitation minière, ont laissé une installation des entreprises minières à capitaux étrangers sur le territoire katangais. L’objectif de l’étude est donc d’analyser l’aspect juridique des entreprises minières et dégager son impact sur le développement socio-économique de la population riveraine. L’étude de cas à portée sur l’entreprise Tenke Fungurume Mining (TFM), créée suite au contrat entre la Générale des Carrières et des Mines (GCM) et LUNDIN HOLDINGS LTD. L’observation a montré que sur le plan socio-économique, TFM a construit et réhabilité les centres de santé et les écoles ; assure une distribution d’eau potable, d’électricité et des intrants agricoles ; garantie un bon travail à la population locale. Sur le plan environnemental, l’entreprise assure d’avoir réduit les impacts négatifs des déchets toxiques sur l’environnement en les traitant avant évacuation. Néanmoins, les activités de TFM ont aussi entrainé sous-développement du secteur agricole, l’exode rural entrainant un déséquilibre social et culturel. Les résultats de l’étude ont montré que l’exploitation minière a un impact tant positif que négatif sur le développement socio-économique de la population Katangaise.
