Abstract


If the reports of international private law between Muslim legal systems and the Occident system have revealed due to the underlying conflict of norms the limited reception of Muslim personal status in Occident. We are convinced that neither the adoption of the domicile factor of international Occident private law nor the adoption of the factor of nationality in Muslim international private law can mitigate the problems of international private law raised by the Muslim's immigration in Occident. In other words, the traditional bilateral conflict rule is not able to reconcile the objectives of international private law of internal tendency and those of international tendency. It has also failed to adopt a pluralistic and private vision well adapted to new paradigms that dominate the world in the 21st century (pluralism multiculturalism, globalism and the computer revolution). In another hand, the advantages of the recognition method has resulted not only from its adapting to these new paradigms, but also the analysis in our research indicate that the application of this method on Muslims personal status in the Occident responds to real needs, namely the continuity of treatment of legal situations without breaking the cohesion and coherence of the internal system. The reason why we promote the recognition method.

Abstract: (french)


Si les rapports du droit international privé entre les systèmes juridiques musulmans et le système occidental ont révélé, à cause du conflit de normes sous-jacent, la réception limitée du statut personnel musulman en Occident, nous sommes persuadé que ni l'adoption du facteur du domicile en droit international privé occidental ni l'adoption du facteur de la nationalité en droit international privé des pays musulmans ne peuvent atténuer les problèmes du droit international privé suscités par l'immigration des musulmans en Occident. En d'autres termes, la règle de conflit bilatérale classique n'est pas capable de concilier les objectifs du droit international privé de tendance interne et ceux de tendance internationale. Elle n'a pas réussi non plus à adopter une vue pluraliste et privatiste appropriée aux nouveaux paradigmes qui dominent le monde du 21ème siècle (pluralisme multiculturalisme, globalisme et la révolution informatique). En contrepartie, le regain de faveur dont bénéficie la méthode de reconnaissance résulte non seulement de son adaptation à ces nouveaux paradigmes, mais aussi l'analyse de notre recherche révèle que l'application de cette méthode au statut personnel des musulmans établis en Occident répond à des besoins véritables, à savoir la continuité de traitement des situations juridiques sans briser la cohésion et la cohérence du système juridique interne. La raison pour laquelle nous favorisons cette méthode de reconnaissance.
